Terms of service

1. Free sample

Before you pay anything, I can build a short sample of your website using your business name and services. The sample is free and you have no obligation to buy. Samples stay my work until you become a client, and they aren't published on your domain.

2. Deposit and balance

• Once-off builds need a 50% deposit before work starts.
• The balance is due before the site goes live on your domain.
• The deposit pays for work already done. Once the build has started, it isn't refunded if you cancel, except where the law requires it.
• Prices are in South African rand. Mogale Web isn't VAT registered, so no VAT is added.

3. Changes during the build

Every build includes two rounds of changes after you see the first version. A round is one list of changes sent together. Further rounds, or new work outside the agreed package, are charged at R350 an hour. I'll tell you the estimate before I start.

4. What the monthly fee includes

• Hosting with HTTPS (the padlock in the browser)
• Renewing your domain every year
• Regular checks that the site is up and the forms and WhatsApp buttons work
• Backups of your site
• Small text fixes on Starter (up to 30 minutes a month), and 2 content updates a month on Business and Booking / Shop. Unused updates don't carry over to the next month.
• On Business and above, keeping your Google Business Profile current

Monthly prices may be reviewed once a year, with at least 30 days' written notice. You can cancel instead of accepting a new price.

5. What the monthly fee doesn't include

• New pages, new sections or a redesign
• Paid advertising, social media management or photo shoots
• Costs from other companies that aren't part of your package, such as a booking system, email mailbox, paid plugin or payment gateway fees (PayFast, Yoco). You pay these directly, or I pass them on at cost after you approve them.

Extra work is quoted upfront, usually at R350 an hour.

6. Cancelling a monthly plan

You can cancel a monthly plan at any time with 30 days' notice by WhatsApp or email. Fees already paid aren't refunded. I can also end a plan with 30 days' written notice, and then hand over your domain and files as in section 8.

7. The R0-upfront plan

The R0-upfront plan costs R749 a month for a minimum term of 12 months. It spreads the cost of building your Starter site over that time, so over the first 12 months it costs more in total than paying upfront. If you cancel before the 12 months are up, a cancellation fee covers the unpaid build cost, and it is never more than the remaining months up to month 12. From month 13, the fee drops to R350 a month and runs month to month with 30 days' notice.

8. Who owns what

• Your content is yours. Your text, photos, logo and business information belong to you.
• Your domain: while you're on a monthly plan, I register and manage the domain on your behalf so it never lapses.
• If you leave, I transfer the domain to you and give you a copy of your website files within 14 days, once everything owed has been paid.
• You confirm that you have the right to use the photos, logos and text you send me.

9. Late payment

If a monthly payment is more than 14 days late, updates may be paused. If it is more than 30 days late, the site may be taken offline after 7 days' written notice. Your domain is kept for you while amounts are outstanding.

10. Your responsibilities

Send content and feedback in reasonable time, and approve the preview within 7 days of receiving it. If content or feedback is still outstanding 30 days after I ask for it, the project may be paused. If it stays paused for a further 60 days, the deposit covers the work done and the project is closed, unless we agree otherwise in writing.

11. Support

Messages are answered within 1 working day (Monday to Friday, 08:00 to 17:00). If your site is down, I start working on it within 1 working day of being told or noticing.

12. Limits

I take reasonable care to keep your site online and working. I'm not responsible for losses caused by outages at other companies (hosting, domain registrars or payment providers), or by content you supplied. My total liability is limited to the fees you paid in the previous 12 months, except where the law doesn't allow that limit.
